Conclusion of the annex to the Contract

The Management Board of Remak - Energomontaż S.A. ("Issuer", "Company", "Contractor"), informs that on 22 April 2022 it has concluded with ArcelorMittal Poland Spółka Akcyjna with its seat in Dąbrowa Górnicza ("Purchaser"), Annex no. 2 to the agreement of 23 July 2019, the subject of which is the performance by the Company for the Purchaser of services within diagnostics and repairs of OPG 140 boilers in Zdzieszowice branch (hereinafter: the "Contract"). The said annex no. 2 extends the term of the Contract until 31 December 2026 and significantly increases the expected value of the Contract, i.e. by PLN 9.000.000,00 net, therefore, after its conclusion, the total expected value of the Contract with annexes, amounts to PLN  16.334.421,45  net.               The above expected total value of the Contract does not constitute a financial obligation of the Purchaser towards the Contractor. The settlement between the parties to the Contract shall be realised as post – executed form. 

The Contract provides for contractual penalties for failure to perform the works within the set deadline for reasons attributable to the Contractor, does not contain a total limitation of the amount of contractual penalties for all reasons, the total liability of the Contractor has not been limited, the possibility of claiming supplementary compensation on general terms has been reserved to the extent that any damage will exceed the reserved contractual penalties. The Contractor's liability for lost profits, consequential and indirect damages has not been excluded. The event was considered significant due to its value and importance for the Issuer.
